1. What Insha'at Collects — Only
- Subscription Fees: For service providers accessing the Platform per selected plan (monthly/yearly).
- Lead Fees: Due when a tender is awarded to a service provider, in exchange for access to the business opportunity.
These payments are processed via a licensed payment gateway (Tap, Tabby) and subject to 5% VAT. These are the only payments Insha'at collects.
2. What Insha'at Does NOT Collect
- Contracting and construction
- Consultant and engineer fees
- Value materials and equipment
- Milestone payments between parties
- Retention or cash guarantees
All such payments are made directly between the client and the service provider in the manner they agree (bank transfer, cheque, cash, etc.). Insha'at is not a party to these transactions.
3. Partner Escrow Option
For optional additional protection
- Telr — UAE-licensed payment and escrow gateway.
- PayTabs — Accredited payment and escrow provider
These services:
- Are operated independently their
- Have their own terms
- Are entirely optional and
- Insha'at is not responsible for the performance, conduct, or failure of these services.
4. Off-Platform Payment Recording Feature
The platform provides record
- Purely informational and does
- Does not send hold or verify any funds
- Does not issue tax
- Does not bind any
Each party retains full responsibility for proving payment per UAE law (receipts, bank transfers, cheques, etc.).
5. Payment Dispute Clarification
Because Insha'at does NOT hold funds, the Platform cannot refund, release, or withhold any payment between parties. In the event of a payment dispute, parties must resort to: (a) direct negotiation; (b) mediation; (c) the competent UAE courts; or (d) arbitration if provided for in their contract.
6. Platform Fee Refunds
Refund policies for subscription and lead fees are outlined in the subscription terms of the selected plan. Refund requests are handled exclusively by Insha'at and do NOT cover any payments between parties.
7. Tax Compliance
Each party is solely responsible for calculating, reporting, and remitting all applicable taxes (including but not limited to UAE VAT, corporate tax, and withholding tax) arising from their transactions. Insha'at provides no tax, legal, or accounting advice. The Platform's VAT registration and tax invoices cover Platform fees only.
