Dispute Resolution

1. Direct Negotiation

Before opening a formal dispute, both parties are encouraged to negotiate directly through the in-platform messaging system. Insha'at's AI-assisted translation removes the language barrier between Arabic- and English-speaking users. Most disagreements are resolved at this stage within 3-7 days.

2. Platform Mediation

If direct negotiation fails, either party may open a formal dispute from the project dashboard. An Insha'at mediation officer reviews the case within 2 business days, examines the contract, milestone history, communication logs, and any supporting evidence (photos, signed sheets, payment receipts). The mediator issues a non-binding recommendation within 7 business days. Disputed funds remain held in escrow during mediation.

3. Escalation & Final Ruling

If either party rejects the mediator's recommendation, the case is escalated for a final Insha'at ruling issued by a senior disputes panel. The ruling is binding on both parties and enforced by releasing or refunding the escrowed funds accordingly. Rulings are issued within 14 business days of escalation and may not be appealed internally.

4. External Resolution: ADCCAC

If the Insha'at final ruling is not accepted, either party may refer the dispute to the Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC), the officially designated out-of-court forum for commercial disputes in the Emirate of Abu Dhabi. ADCCAC proceedings are conducted in accordance with UAE Federal Law No. 6 of 2021 on Mediation and Abu Dhabi Law No. 14 of 2021. Insha'at will comply with any ADCCAC award and release the disputed funds in accordance with its ruling.
